Registration in the register of public sector partners is a necessity for most entrepreneurs who supply goods and services to the state and its organizations.

Who is a public sector partner?

Pursuant to Act No. 315/2016 Coll. on the Register of Public Sector Partners, a public sector partner is a natural or legal person who receives monetary funds or property from public sources above the statutory limit of EUR 100,000 for a single payment and EUR 250,000 for multiple payments. This obligation also applies to persons who are awarded contracts in the framework of public procurement or the supply of goods and services.

A public sector partner cannot enter themselves into the register. Only an authorised person may make an entry as stipulated by law, and our law firm is such a person.

It is also necessary to register end user benefits in the register.

Who is the end user of the benefits?

Pursuant to Act No. 297/2008 Coll. on Protection Against Money Laundering, the end user of benefits is any natural person who actually manages or controls the entity. It is a person who has a share of at least 25% of voting rights, who has the right to appoint or remove a statutory body, a person who controls a legal person in another way, or has the right to an economic benefit of at least 25%. If there is no such person, the end users of the benefits are the members of the top management, i.e. the statutory body, the procurator, etc.
